Don’t Let an Expired Producer License Cancel Your
Surplus Line License
As the year winds down, it’s a good time to make sure your licenses — and your peace of mind — are in order. One of the most common issues we see is the unintentional lapse of a member’s Producer license, which can have immediate consequences for a member’s Surplus Line (SL) license.
Under Illinois law, a valid Producer license is required in order to hold a valid Surplus Line license. If the Producer license expires or is not renewed on time, the Surplus Line license automatically cancels. This means the licensee loses their authority to transact surplus line business until both licenses are renewed.
Here’s what this means for you:

If your Producer license expires, your Surplus Line license is canceled automatically.

Public Act 104-0091 — Effective January 1, 2026 |

|
On January 1, 2026, Public Act 104-0091 (SB 1289) will take effect, revising Section 445 of the Illinois Insurance Code. The bill makes changes that simplify the definition of “home state” in the case of multiple unaffiliated insureds on a surplus line policy.
While much of Section 445 remains the same, this amendment continues the state’s ongoing effort to establish best practices and modernize Illinois law.
